Protect the exterior appearance of your product
The registered design guarantees an exclusive right on the external shape to market a new and original product.
We take care of everything necessary for the registration of an Italian national design at the UIBM or a European Union design at the EUIPO, without the owner having to worry about it.
Registration fees are excluded and must be paid directly to the competent Office (approximately 350.00 Euro in the case of a single D&M from the European Union and approximately 150.00 Euro in the case of a single national D&M).
DESIGN REGISTRATION
In order to register a design (see articles 32 and 33 of the Italian Civil Code) it is necessary that it has:
- novelty;
- individual character.The novelty requirement is considered to exist if no identical design or model has been disclosed prior to the date of filing of the application for registration. Disclosure occurs with any display that has made it accessible to the public (including publication on online social networks).
The general rule is that all designs disclosed are no longer registrable. The only exception is the "year of grace" rule, which allows registration within one year from the time of disclosure.
A design has individual character if the overall impression it produces on the informed user differs from the overall impression produced on that user by any design which has been made available to the public before the date of filing of the application for registration or, where priority is claimed, before the date of priority.
